Terms and Conditions
eviivo limited (headquartered at 154 Pentonville Road, London, N1 9JE Registered under number 05002392) (« eviivo ») operates from a technical point of view the Site where you have booked your stay. You agree that eviivo is not a party to the booking agreement between You and the Establishment (the ‘Agreement’). eviivo has no control over the type and quality of the establishment, nor the quality of its services, nor the reliability of the information presented by the establishment on this site. eviivo would not be liable for any act or omission, or for any indirect damage (including loss of profit, loss of revenue, loss of money, waste of time, missed opportunities), or any other wrongdoing or damage that is not directly caused by Us or We could reasonably have foreseen. Nothing in this clause shall exclude or limit the liability of eviivo in the event of fraud or in the event of death or serious injury caused by the negligence of eviivo.
Conditions of sales
The present terms and conditions (‘Conditions of Sale’) bind the natural or legal person (‘You / Your’ / ‘Vos’) who makes a reservation (‘Booking’) and the temporary accommodation service provider whose name appears in your confirmation email (‘The Confirmation’) (‘We / Our / Ours’). These Conditions of Sale are subject to the competent courts under the conditions of common law, and apply exclusively to all Reservations taken in Our establishment. You confirm that you are over eighteen (18) years of age and have the legal right and ability to make and pay for Your Reservation.
Booking
When Your Reservation is confirmed a Reservation Number is sent to you by phone, online or by email. This Reservation Number is required and necessary if You wish to cancel or change Your Booking later. You will also be asked to quote this reservation number in reference in all Your communications with Us.
Your Reservation will be considered final when You have received Our Confirmation and, according to the payment terms indicated and accepted by You, We will either have (i) cashed the total value of the Reservation, or (ii) cashed an amount less than the value reservation as specified at the time of booking or (iii) been able to guarantee your reservation by credit card. Indeed, to be valid Your Reservation must be guaranteed by credit card or Paypal or any other means of payment which We would have agreed. You have no right of withdrawal.
Prices
Rates are expressed in the currency indicated on Your Confirmation and at the time of payment of Your Reservation and include VAT or other applicable taxes. The price of the reservation is based on the number of people, the number of nights, the dates and type of rooms specified in Your Confirmation.
Any additional products or services specified at the time of booking are also included in the total value of your booking. Unless otherwise stated, the rates quoted on Your Confirmation do not include charges and additional purchases or services incurred by You during Your stay.
Availability
In the very rare case where We would not be able to provide you with the temporary accommodation corresponding to the description and conditions mentioned in Your Confirmation, We will offer you replacement services. If the rate of replacement services offered is lower than the advertised and prepaid rate, the difference will be refunded. If the rate applicable to the replacement services is higher than the advertised rate, We will take in charge the resulting price supplements, insofar as the quality and nature of the replacement services are reasonably comparable to the services originally offered. in your reservation.
Arrivals and departures
Arrival (check-in) and check-out times are specified in Your Confirmation. If you wish to arrive outside the hours indicated in Your Confirmation, please contact us directly to reconfirm your arrival time. If your arrival exceeds the normal hours or the expected time of arrival, and this without prior agreement with Us, We have the right to cancel Your Booking on the entire stay and to require the payment of the cancellation penalties stipulated in Your Confirmation.
Modification and cancellation
The modalities for changing or canceling Your Bookings are indicated in the « Cancellation Conditions » section on the Confirmation sent to you by e-mail.
If you cancel Your Booking beyond the cancellation deadline (‘Deadline Date’), all cancellation penalties specified on Your Confirmation, including, as applicable, any additional products or services that are part of the Reservation, will be payable.
No-show on the planned day of arrival is considered as a complete cancellation of Your booking for the entire stay and we are therefore not obliged to ensure that the selected temporary accommodation remains available.
If you change Your Booking, number of occupants, dates or room type (‘Change’) rates are subject to change. If You request a Change and We are unable to accommodate it, Your Reservation may be canceled. If the cancellation occurs before the deadline specified on Your Confirmation it may be subject to the late cancellation penalties specified on the Confirmation.
Payment
The amount of the Reservation to be paid is indicated in Your Confirmation. This amount will be debited from your credit card account or Paypal account following the sending of Your Confirmation. The order will be automatically canceled if your bank card is refused by the bank or in case of default of your account.
The payment of any remaining balance, other goods, products or services consumed during Your stay with us must be paid by You in its entirety before Your departure. If you were to leave Our establishment without paying Your balance We remain entitled to debit the credit card you submitted at the time of booking any outstanding balance.
CAUTION – your credit card details are processed in accordance with PCI-DSS security standards to guarantee Your Reservation. Beyond the Cancellation Limit Date, We reserve the right to pre-authorize or even debit the value of your credit card cancellation penalties. Similarly, if a deposit is due from a certain date, We reserve the right to pre-authorize or debit your credit card the amount of the deposit on its due date. When it is simply a pre-authorization, no amount is debited from your account but the credit available on your credit card can be reduced by an amount equal to the value of the cancellation penalties or the amount of the deposit in question.
Responsibility
We do our best to describe the type of accommodation offered, the location of our establishment, its level of comfort and its main characteristics, its approval and its tourist classification in accordance with the regulations in force but We are not able to You ensure that our services meet your expectations, in any way. If you have any questions regarding the specific accommodation conditions and services offered by our property, we invite you to contact us directly BEFORE the cancellation deadline and we will do our best to answer them.
We can not be liable to You for the non-performance of any of the obligations incumbent upon us hereunder, which is not ours (fraud, misrepresentation, etc.), or which would be due to the occurrence of a case of force majeure. In any case, Our responsibility can not exceed the amount paid by You and We cashed for Your Reservation.
We strive to deploy all the care and diligence reasonably necessary for the proper performance of Our obligations. We will not be liable for any indirect damage (including loss of profit, loss of revenue, loss of money, waste of time, missed opportunities, or any other harm or damage that is not directly caused by We ) or that We could not reasonably foresee.
You are responsible for any damage, loss or harm suffered by Our establishment as a result of your fault (acts or omissions) or negligence on your part. In this case, You agree to pay us directly any amount reasonably necessary for the repair of such damage caused by You. We reserve the right to cancel Your Reservation immediately and without refund, in the event that Your behavior during the stay ceases to be reasonable and / or responds to serious complaints from the staff of the establishment or other guests of the establishment.
Protection of personal data
It is reminded that the personal data concerning you are necessary for the processing of your reservations. This information is recorded in Our system and transmitted to Our Service Providers who handle the processing of Your Reservation. You have a right of permanent access, rectification and opposition regarding the information concerning you. To exercise this right, You must send us a letter to the address indicated on your confirmation.
The transmission of Your data to our service providers is for the sole purpose of allowing us, and allowing our service providers, to process your reservation. If necessary, our company and our service providers can transmit your data within their group, in all the countries where they can operate.
One of these providers is eviivo Limited (registered under number 5002392 and headquartered at 154 Pentonville Road, London, N1 9JE) which may be required to process Your data in its call center in Tunisia. The following warranties have been made by Us and eviivo Limited to ensure a sufficient level of protection of Your personal data: (i) any entity or provider that processes your data outside the European Union provides a level of adequate protection by decision of the European Commission. (ii) Your personal data is used for the sole purpose of processing Your Booking.
By placing a reservation on Our Site you consent to the processing of your personal data as described in the clauses above, including their transmission to our service providers.
